'It's either them or me': Homeowner's attorney speaks out on Deerfield fatal shooting

I started a gofundme for the homeowner and talked with his attorney today. The homeowner, who is 64 used his dead fathers revolver to kill two people who were burglarizing his home, the he fucking gets charged for possessing an undocumented firearm and is sitting in jail now facing a felony. Fuck I hate New York!

Yeah whats your point? I won my criminal case by proving the cop lied using his own dashcam video. Yes they took my truck but the decision was recently overturned and the lawfirm representing me will get it ruled unconstitutional. I got some money coming my way. Also, becuase of my case and going to the news I helped to get North Dakota to reform their civil asset forfetuire laws. SOO, whats your point here?

Sure bud, I aint got shit to hide, the grand larceny was from my house I was renting out, the tenants never put the utilities in their name and after they moved out the fucking utility company claimed I stole the power and I got charged as being owner of the house and they claimed I lived there. It got tossed out but I had and 1/8 of weed on me when they arrested me. 

 

And as of now Im a stay at home dad considering I lost my fucking truck I needed to transport my antiques and do cleanouts and get my inventory up. I fucking lost my home, my truck and all my tools and sold off most of everything I owned becuase of this shit, a fucking cop lying. So you can fuck off buddy! At one time I had my own construction business, property managment business, vending machine business, lawn care business and I had just started getting into the antique business when this shit happened to me. SO yeah I dont have any money at the moment to pay for an attorney to fight this bullshit, and fuck off with your morality bullshit, I aint collecting welfare you twat!

I have sympathy for the guy and respect his right to defend himself, however, the law is the law. If you live in a state with gun laws (sensible or not) you best comply with them. Registering the gun in his name would have been a simple beaurocratic exercise. "Not knowing" is no excuse.

I blame the government, like they don't even care what happens to the guns when ppl die, when someone dies and they have a gun registered to their name they should get a notice on the computer, and send an invitation to whoever was the heir, either to turn in the gun at the police station for destruction, or to register it.

It was his dead fathers revolver. He didnt have the money to pay for a pistol permit, fuck he doesnt have money for a car or drivers liscense. And yes the attorney looks shabby but he is the only one around who isnt corrupt as fuck, probably the reason he is not a wealthy attorney. I've known the attorney for many years now. He's a good guy.

According to google: The application in Oneida County costs 10$, a gun handling course 35$. He would have needed 4 or 5 character winesses and a little patience.

So? Getting guns licensed and registered does not infringe that right. In order to do so you simply have to comply with local regulations. Don't like it? Move somewhere where the rules actually are to your liking.

Yes it does.  A license infers that to which it applies is a privlidge.  Rights are distinct from privlidges in that rights do not require permission.

 

Suppose I claimed you needed a license before speaking in public.  Freedom of speech is a right.  Does it makes sense that you would need to seek permission before doing what is your right?

 

These sorts of issues and ideas are why Europe is dying.  You think like slave and defend being treated like one.  And your master is the State.  Whereas in America the Citizen is the master and we do not ask our slave for permission.

well. if you got past offenses, dishonorable discharge, mental illness or state-approved medicinal marijuana, you dont have the right to bear arms. you have to ask permission. wouldn't that infer the right is actually a privilege that has conditions?

 

same goes for freedom of speech. you could say its a right, but you can't exercise that right outside someones home on tuesday at 3 am.

*alleged* burglars. you can't just assume people need to die. sure arm yourself, fire a warning shot if shouting doesn't work. there's a lot of reasons we have courts and lynching is bad, and one is just plain old mistakes. someone got the wrong address, kids sneaking home because they were grounded, even just pranks. even in war casualties are avoided as much as possible, so more people are taken prisoner than shot.

  1. In a country where many people have a gun simply because it is "their right" any "breaking and entering for a prank" one would have thought is literally unheard of. If someone enters my home they deliberately have to overcome safety measures, so for me it would be safe to assume they want nothing good.
  2. With a pistol, even at close range, you don't fire warning shots, especially when you don't use the thing every day. You shoot to do as much damage as possble to stop the intruder. You only have between 6 and 20 attempts and a high stress situation so you want to save as muchh ammo as you can
  3. In a war situation there are trained people following close orders (unless you are at war with the US who also emply private companies to aid in their dirty work), in a home intrusion (in the US) you most probably have a completely untrained idiot who can count themself lucky to find the safety on a gun they maybe used once or twice before. Look at the level of training "professional" police receives, it is ridiculous. Allowing those people to operate guns automatically results in serious injuries and fatalities.

1. i don't mean breaking and entering for a prank, i said "for a prank", as in those hundreds of videos on yt where people go to their friend's house to prank them, ghost pranks are common but there's fake cheating, fake murderous psychopaths, etc. usually the pranks just runs for their life, occasionally it turns violent, and occasionally someone gets shot and killed.

 

2. you say "intruder", but it's "alleged intruder". people killing their sons or neighbors because they thought it was an intruder trying to break in happens all the time. just a few days ago an amazon delivery guy was nearly shot just trying to do his job.

 

3. agree, it's the lack of training, and hence why your points for 1 and 2 are incorrect. with reasonable gun licensing we would have only trained people with firearms, and all the mistaken deaths would not happen. if this guy had had training he wouldn't have shot those 2, and the same goes for the thousands of people mistakenly shot all across the country every year.

agree also about the police traing. they seriously need to get rid of those army trainers and reopen their proper police academies.

regarding 3: Sorry my points for 1 and 2 are absolutely correct. 

 

If a prankster gets hurt or killed it is their fault. They should actually know the kind of idiot they are pranking. That is why the guy is only (and rightfully) charged with registration issues and not manslaughter or murder. This is in the US, so we have to deal with the current situation in the US and not in other countries or a science fiction scenario: Untrained panicking people wielding guns to "protect themselves".

I'd also mention that in a place where its extremely easy to get a firearm, if someone is burglarizing a house theres a solid chance they have one. It makes more sense to commit a crime with one, than without if literally anyone can get one.

yes but you're assuming those are exclusive and definite things, which they're not. in other burglaries, the burglars hear someone coming so they decide to leave, but then they get shot at, so they shoot back and the homeowner dies. 3/4 of all crimes involving guns turn into homicide, whereas if there are no guns everyone tends to live through the experience.

 

by the way sorry to read above about your trouble with your tenants. sounds like you got the real short end of the stick and for no good reason. those utilitiy companies coming after you because they couldn't be bothered to do a little investigation first just pisses me off. hope everything starts to work out for you.

Yeah thats why it got tossed, the company told the police there was no "active user" but told the grand jury that the meters were bypassed to make it a criminal offense. They threw every deal at me as all they wanted was for me to pay the bill in the form of restitution but I held out until 2 days before the trial and the judge finnally dropped it after reading the grand jury minutes. He called in the power company investigator that worked with the cops in getting the search warrant and he said they "mispoke" but even then the judge didnt drop it, it took me calling their bluff and standing my fucking ground before they dropped it. I tried to sue but every lawfirm wanted $15-20K to file the lawsuit even though they all agreed I have a lawsuit and could get around $250K. I just didnt have the money then so I dropped it. They are all corrupt as fuck man. Its like the cops were their hired goons.

In fact I went to the same attorney that is representing this guy. He wanted the lowest amount but it was still $10k.

 

Oh by the way, the meters were in the basement of the house as the utilities were underground, thats why they couldnt pull the meters on the tenants, they never let them in and thats why they had to get a search warrant. They busted the door all to shit, a 150 year old door busted in and ruined becuase of their shit. Fuck them!
