In the US cops have to have probable cause, i.e. a valid reason, for a search. swerving a bit on the motorway is enough reason to stop someone for suspected DWI but but this and "seeing how the person moves her handbag" are probably not enough for a search, this is why the cop asked.
If bodycamboobs doesn't consent and they search anyway all the evidence found will be disregarded should the court later decide the search was. As she consented all the evidence is valid in court.
So yes, it makes a huge difference, in the US.
Here in spain it is quite different, as long as you are on public roads there is little or nothing you can do if they want to search your car.

You have it dead on. That's exactly the law here in NY. Unfortunately, what the cops do a lot is call for a sniffing dog if you deny a search because they "suspect drugs" and the evidence found is logged in your arrest. Then, if you have a connection-legal/political-you pay a very expensive lawyer, it all goes away or your punishment will be country club variety. If you don't-like you aren't white, don't have the money, no connections, have even a slight record, etc.- then the legal system will crush you. All the evidence will be used, the judge will accept everything from "Law enforcement", and punishment will be life changing and stay with you forever..
I just went through this. They found nothing after a dog search and were pissed so they arrested me for a DUI, I refused a field test, and was brought to the police station, passed 4 -FUCKING FOUR--breathalizers, and bailed myself out. They just said I was cheating the breathalizer. I'm serious. Zero connections but paid a very expensive lawyer who delayed, delayed, delayed (sound familiar?) until we got the right judge and it was over in 45 seconds. One of the cops showed up the last day and testified I was slurring and had to use my car to hold myself up. My lawyer had video of me at the police station walking around in handcuffs better than the cops and he was connected to the judge. It all took over a year and cost big money. Seeing it all from the inside it was obvious it's all just a money-making grift. They don't even hide it. Who are you going to complain to? The police? The legal system? Our solid politicians? Good luck.

Sounds exciting. And time consuming. So you wore them down by filing delay after delay, which is certainly one strategy.
But how can they accuse you of faking out the breathalyzer. It only takes a reading if you blow and from what you describe, you blew, and passed.

Four cops in the room said that I was trying to cheat the breathalyzer. That's all it took. Four against one. If you don't pay for a top notch lawyer, you get screwed.
I faked out the breathalyzer because they said I did. Period. They conveniently had no body cameras . The video from inside the police station was the clincher. It was so obvious they were lying. The lawyer initially got a "We can't find the video" too. A shitty lawyer would just shrug. They tried every trick in the book because I was justifiably pissed off and played good cop/bad cop, insults,etc to try to get me to yell. I said nothing and that got them all riled up.
